SPAN Submits Comments to Maine DEP Concerning Currently Unavoidable Use Rulemaking

On January 28, 2025 the Sustainable PFAS Action Network (SPAN) submitted comments to Maine’s Department of Environmental Protection regarding the state’s proposed rules for notification requirements, sales prohibitions, and Currently Unavoidable Use (CUU) determinations for products containing intentionally added PFAS under Maine’s PFAS in Products Program.

The comments call for important modifications to the proposed rules to responsibly balance long-term human health and environmental protection with the critical need for certain PFAS materials for Maine’s economic growth.

Failure to implement some of the requested changes will adversely impact access to certain products and materials in Maine that are of critical importance. For example, the failure to guarantee the protection of proprietary information could render the CUU exemption process unusable for many product manufacturers, including those critical to national security.
